Terms of Service
These Terms of Service (“Terms”) govern the purchase and use of genetic test kits, blood panels, and consultation services (the “Services”) offered by TruGenetics LLC (“TruGenetics,” “we,” “us,” or “our”) through thetrugenetics.com (the “Site”). By placing an order or using the Site, you (“Client” or “you”) agree to these Terms.
- Services. TruGenetics provides at-home genetic test kits, third-party laboratory blood panel testing, and one-on-one consultations to help clients understand genetic and biomarker data related to their health and wellness.
- Not Medical Advice. TruGenetics’ test kits, blood panels, and consultations are for informational and educational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease and are not a substitute for advice, diagnosis, or treatment from a licensed physician. A consultation is educational in nature and does not create a doctor-patient relationship unless expressly stated for services performed through TruGenetics’ affiliated medical clinic.
- Client Information. Client agrees to provide true, accurate, and complete information when placing an order or providing a sample. TruGenetics is not responsible for inaccurate results or delays caused by incomplete or inaccurate information.
- Laboratory Testing. Genetic test kits and blood panels are processed by third-party CLIA-certified and/or CAP-accredited laboratories. Turnaround times are estimates only and are not guaranteed.
- No Guarantees. TruGenetics does not guarantee any specific outcome, result, or health benefit from its test kits, blood panels, or consultations.
- Limitation of Liability. To the fullest extent permitted by law, TruGenetics and its officers, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from the Services. TruGenetics’ total liability for any claim will not exceed the amount Client actually paid for the Service giving rise to the claim.
- Indemnification. Client agrees to indemnify and hold harmless TruGenetics and its officers, employees, and affiliates from any claim, loss, or expense (including reasonable attorneys’ fees) arising from Client’s breach of these Terms or misuse of the Services.
- Governing Law; Venue. These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in New Jersey, and each party consents to that jurisdiction.
- Assignment. These Terms may not be assigned by Client without TruGenetics’ prior written consent.
- Entire Agreement; Amendments. These Terms, together with our Privacy Policy, are the entire agreement between Client and TruGenetics regarding the Services. TruGenetics may update these Terms from time to time; continued use of the Site after changes are posted constitutes acceptance.
Refund Policy
All sales of genetic test kits and blood panels are final. TruGenetics does not offer refunds, exchanges, or credits once an order has been placed, except as described below.
- Order Cancellation. An order may be cancelled for a full refund only if the request is received before a kit has shipped or before a blood draw has been scheduled. Once a kit has shipped, or a blood draw has been scheduled or completed, the order is final.
- Consultations. Consultations may be rescheduled or cancelled for a full refund if the request is received at least 24 hours before the scheduled appointment. No refund will be issued for missed appointments or after the consultation has taken place.
- Damaged Kits. If a kit arrives damaged, contact us within 7 days of delivery for a replacement at no charge.
- Billing Errors. If you believe you were charged in error, contact us within 60 days of the charge for review.
